    Israeli Border Police Killed a 4-year-old Palestinian Girl, Then Took 10 Days to Return Her Body

One of them, a little girl, was shot dead > *** > Ruqayya Jahalin was going to celebrate her fifth birthday on February 9, 2024. But that will never happen because about a month ago, she was shot and killed by Israel Border Police troops. They fired no fewer than 32 rounds at the shared taxi in which the little girl was traveling with her mother, sisters and brother, on their way home, in the West Bank. Miraculously, she was the only person killed by the insane, indiscriminate gunfire. > > She was sitting in the middle of the back seat of a Ford Transit when a bullet slammed into the vehicle from the back and stopped in her chest. Her body was removed from the van by the police officers and lay on the road for about six hours before her shocked parents were allowed to approach. The officers then took the body away and only returned it to the grieving family 10 days later. This is how, in both life and in death, Israel treats both the bodies and the dignity of Palestinians, even of little children who don't make it to the age of 5. > > Beit Iksa is perhaps the most besieged and alienated village in the West Bank. Because of its location, northwest of Jerusalem, adjacent to the post-1967 neighborhood of Ramot, Israel closed its only entrance off with a temporary barrier in 2008, replacing it two years later with a permanent one. In the last 13 years only officially recognized residents of Beit Iksa, approximately 1,900 people – some of whom have blue (Israeli) ID cards, while others have special permits – have been allowed to enter. > > The closure has become even tighter since the start of the war in Gaza. Previously, nonresidents were able to get special permission from the District Coordination Office to enter the village to attend weddings or funerals, or for other reasons, but that's no longer allowed. Cooking-gas canisters may be brought in, but only of one color, fodder for sheep is on the permitted list but any new flocks from outside have not been allowed into Beit Iksa since October 7. The connection between bringing sheep into the village and the war in Gaza and Israel's security is obvious, right? It was into this surreal, Gaza-style reality that Ruqayya Jahalin was born. > > Her family is split up. Her father, Ahmed Jahalin, a 40-year-old construction worker and shepherd, is married to two women and has nine children. Six of them live with Aisha, 38, Ruqayya's mother, in Beit Iksa. The other three live with Rabaa, 30, and Ahmed in a neighborhood called the Western Valley in Arabic, of the town of Beit Hanina in the West Bank (other parts of town are within the municipal bounds of Jerusalem). Complicated? Such is the bureaucracy of the occupation. > > Footage of the incident > > Aisha and her children frequently visit Ahmed in the collection of shacks where he lives with his other family. Indeed, the youngsters attend school in the Western Valley on weekdays and sleep over in their father's place, rejoining their mother in Beit Iksa on the weekends. Ahmed, who worked in the settlement of Givat Ze'ev until the war erupted, is now unemployed, as Israel has barred Palestinians from working in Israeli locales ever since. He's now forced to rely on his small flock of about 30 sheep to support his families. > > Ruqayya was his second-youngest child – only her brother 3-year-old Mohammed is younger. On Sunday, January 7, Aisha brought four of her children, who were on a winter break from school, to visit their father in Beit Hanina, which is about 15 kilometers from their home. That afternoon, they headed back to Beit Iksa. A friend of Ahmed drove Aisha and the children – daughters Marwa, 15, Rahma, 12, and the two little ones, Ruqayya and Mohammed – to the village of Bidu, where they got into a shared taxi heading to Beit Iksa, driven by a resident who is permitted to enter and leave it. The family was joined in the Ford Transit by two other Beit Iksa women; one sat next to the driver and the other was behind her. Aisha and Marwa sat in the middle row of seats, and Mohammed, Ruqayya and Rahma were in the back. > > After a short drive they reached the checkpoint at the entrance to their village, where they had to undergo the usual strict procedure, waiting while other vehicles were stopped and checked before approaching cautiously and slowly. Three Border Police troops were at the checkpoint, Marwa tells us now, two men and a woman. The latter quickly checked the IDs of the passengers in the taxi, to ascertain that they were residents of Beit Iksa, then had a look inside the taxi to ensure that they weren't smuggling in sheep or other contraband. The driver was then allowed to proceed toward the iron gate at the other end of the checkpoint, which the female officer ran to open. Everything followed the usual, well-entrenched checkpoint routine. > > Suddenly shots rang out. Heavy gunfire came from behind the van and the passengers had no idea what was happening, says Marwa: "We were scared, we shouted, a few bullets hit the floor of the taxi, under our feet." The driver, paralyzed by fear, stopped the vehicle immediately after passing through the gate. Aisha tried to protect her children, gathering panicky Rahma and Mohammed to her from the back seat. She then pulled Ruqayya toward her – and was appalled to see blood streaming from her back. > > Marwa relates that her mother screamed that she wanted to get out of the taxi and rush Ruqayya to a hospital, but the driver warned her that if she got out of the vehicle, she too would be shot. He summoned an ambulance from Bidu, which arrived within minutes, but Israeli security personnel prevented it from passing through the checkpoint, to reach the taxi on the other side. > > Panicked and desperate, Aisha continued to scream as she saw her little daughter fading before her eyes. After about 15 minutes, Ruqayya stopped breathing and her eyes rolled back into her head, Marwa says, adding that they were forced to stay in the taxi for a total of 20 minutes, which felt like an eternity. Aisha yelled to the driver to call Ahmed. None of the Border Police personnel bothered to approach to see what had happened inside the van. > > When we visited her on Monday at Ahmed's home in Beit Hania, Marwa, a shy teenager, consented to have her picture taken, but only with her father, not alone. The trauma of having her little sister shot dead next to her was still apparent when we spoke to her, along with Iyad Hadad, a field researcher for the Israeli human rights organization B'Tselem, who investigated the incident. > > She recalls that the Border Police officers finally came over and asked the driver why he wasn't leaving. "We have a wounded child here," he told them. Only then did security personnel approach the dying Ruqayya. The passengers were then allowed to get out of the vehicle, says Marwa, and to carry Ruqayya to the checkpoint. Paramedics in the Israeli ambulance that had meanwhile been called to the site examined the child, but in short order told Aisha that her child was dead. > > It turns out that after Ford Transit was given the go-ahead and started to move toward the iron gate, a car suddenly appeared behind it and burst into the checkpoint area without stopping next to the Border Police. Footage from the security cameras shows the course of events: The Ford Transit advances slowly after passing the officers and then a smaller car speeds in. The Border Police open heavy fire on the car and run after it. According to Hadad's report, 32 rounds struck the taxi with the women and children in it, four slamming into the seats and 28 into the chassis. One bullet killed the little girl. > > The B'Tselem researcher reports that the only passengers in the car that burst into the checkpoint area, and who were summarily shot to death, were a married couple from Bidu: Mohammed Abu Eid, 37, a gardener who was employed in Israel until the war, and his wife, Doha, 31. They had four children aged 14 and 10, in addition to 2-year-old twins, both of whom have a congenital heart defect and recently underwent open-heart surgery. What made the couple speed through the Beit Iksa checkpoint, knowing that that was basically an act of suicide? The couple had no record of security offenses or history of psychological problems. Relatives suggest that something may have gone wrong with the car, but that seems like a far-fetched possibility, judging from the way they drove. > > Another possibility raised this week is that the couple wanted to die because their economic situation had become untenable, with Mohammed out of work and costly medical treatment needed for the twins. One account, which is unverified, says he took leave from some of his friends on the day of the incident. As far as is known, the Abu Eids were on the way to pay their condolences to a family in Beit Iksa – but they would have known that there was no entry into the village and that such a visit was impossible. > > There is no hard evidence that this was a rare instance of Palestinians committing suicide in that fashion. What actually happened? We will probably never know. The couple were killed in the heavy volley of gunfire and Israel has not yet returned their bodies to their families. > An Israel Police spokesperson stated this week in reply to a query from Haaretz: "The investigation of the terrorist ramming attack at the Ras Bidu crossing is still ongoing at this time, with the aim being to arrive at the truth of the matter and to determine the precise circumstances of the incident." > > It emerges that Border Police personnel kept Ruqayya's father, Ahmed, who was summoned to the scene by the taxi driver, from approaching his daughter in her final moments and trying to calm his distraught wife and children. He was compelled to wait at the checkpoint for six hours, he says, while his daughter's body lay on the road, wrapped in a black plastic body bag, next to those of the couple from Bidu. Ahmed asked to be allowed at least to stand next to Ruqayya's body, but the police refused. Finally, security personnel took the body away and told Ahmed he would receive it the next morning. > > "Ten days I waited for her," the father tells us. The police wanted to perform an autopsy and the family refused, but a Jerusalem court gave the green light. An international NGO for the protection of children made a lawyer available to the family, who handled the contacts with the authorities for the return of the body. > > Finally, 10 days after she died, Ruqayya, was buried in the soil of her father's village.

TraumatisĂ©e par ce qu’elle a vu Ă  Gaza. « Elle entendait des bruits sourds des bombardements. Elle en faisait des cauchemars. » Chaque soir, elle prenait place dans le lit du couple, paralysĂ©e Ă  l’idĂ©e de dormir seule. Les parents lui ont trouvĂ© un psychologue, qui l’a suivie quelque temps. Aujourd’hui, elle est trĂšs sociable, se rĂ©jouit Shaden, qui prĂ©cise qu’elle a malgrĂ© tout toujours besoin qu’on l’accompagne lorsqu’elle se rend aux WC. > > Mais alors que la fillette allait mieux, elle voit dĂ©sormais ses parents, et notamment sa mĂšre, pleurer en lisant la presse arabophone ou en regardant Al Jazeera. Ce jeudi 8 fĂ©vrier dans l’aprĂšs-midi, la chaĂźne montre les images de Rafah, oĂč plus d’un million de dĂ©placé·es survivent sans rien ou presque aprĂšs avoir fui la bande de Gaza, dont les habitations sont ravagĂ©es par la guerre. > > « On essaie de ne pas regarder les infos quand les enfants sont lĂ , mais ils ressentent tout », regrette Shaden, dont la famille a trouvĂ© refuge sous les tentes de Rafah. Son frĂšre, Majd, est dĂ©cĂ©dĂ© sous les bombardements, alors qu’il se trouvait dans le salon de la maison familiale, dans un quartier du centre de la bande de Gaza. Il avait 23 ans. > > « Ma famille n’a pas voulu me le dire tout de suite, mais j’ai vu son nom sur Telegram et j’ai compris. » Ce soir-lĂ , son pĂšre est blessĂ© Ă©galement. Il a depuis une fracture, suppose-t-elle, mais il n’ose pas se rendre à l’hĂŽpital sachant toutes les urgences qu’il y a Ă  traiter, comme les amputations. > > Sur son ordinateur, Ibrahim fait dĂ©filer les photos de cet « enfer » : la maison de la famille de Shaden, pulvĂ©risĂ©e et rendue Ă  l’état de ruine, mais aussi le visage ensanglantĂ© de son frĂšre dĂ©cĂ©dĂ©, le corps enveloppĂ© d’un linceul blanc, sur lequel se penche un proche. « Ça, c’était notre appartement », dit-il, l’air blasĂ©. En tout cas ce qu’il en reste. > > ##Une OQTF suspendue mais pas annulĂ©e > > Et « malgrĂ© tout ça », la prĂ©fecture d’Ille-et-Vilaine voudrait les « renvoyer » lĂ -bas ? « Ils veulent mettre en jeu notre vie, nous envoyer Ă  la mort », souffle l’homme ĂągĂ© de 37 ans, qui ne se considĂšre pas comme « immigré » ou « migrant », termes parfois pĂ©joratifs et instrumentalisĂ©s, mais comme « expatrié ». > > Depuis prĂšs d’une semaine, le couple est sous les feux des projecteurs. Un article de Ouest-France est venu mettre en lumiĂšre la situation ubuesque dans laquelle ils se retrouvent plongĂ©s, depuis que la prĂ©fecture a refusĂ© leur demande de titre de sĂ©jour « vie privĂ©e et familiale » et leur a en sus dĂ©livrĂ© une obligation de quitter le territoire français (les fameuses OQTF). > > Comment est-ce possible ?, s’interrogent-ils. « On sait qu’on a droit Ă  ce titre grĂące Ă  notre intĂ©gration. On remplit les critĂšres, on a des amis français, j’ai une promesse d’embauche », Ă©graine Ibrahim, qui dit ne pas comprendre comment les autoritĂ©s ont pu prendre une dĂ©cision pareille. > > Face au tollĂ© provoquĂ© par l’article de Ouest-France, la prĂ©fecture n’a pas tardĂ© Ă  rĂ©agir en publiant un communiquĂ©, dans lequel elle prĂ©cise que « contrairement Ă  ce qui est relayĂ© sur les rĂ©seaux sociaux, aucun Ă©loignement vers la Palestine n’est organisĂ© dans le contexte actuel ». « Les intĂ©ressĂ©s se sont vu notifier des obligations de quitter le territoire français (OQTF) en mai 2023, avant les Ă©vĂ©nements tragiques qui se dĂ©roulent actuellement Ă  Gaza », poursuit-elle, indiquant que la mesure d’éloignement est « suspendue ». > > Mais l’OQTF n’est pas annulĂ©e pour autant et l’affaire court toujours devant le tribunal administratif de Rennes, puisque le couple a contestĂ© la mesure d’éloignement en novembre dernier, et a dans le mĂȘme temps formulĂ© une demande de rĂ©examen dans l’espoir d’obtenir l’asile en France. > > La prĂ©fecture attend donc simplement que la demande soit traitĂ©e, ce qui signifie concrĂštement que le couple pourrait ĂȘtre expulsĂ© en cas de nouveau rejet de sa demande. Dans son mĂ©moire en dĂ©fense datĂ© du 23 janvier, que Mediapart a pu consulter, la prĂ©fecture assume d’ailleurs vouloir Ă©loigner Shaden et Ibrahim malgrĂ© le massacre en cours à Gaza. > > « Le couple ne dĂ©montre pas ĂȘtre dĂ©pourvu de toute attache dans leur pays d’origine », peut-on lire pour justifier l’OQTF. Puis plus loin : « S’il est exact que la situation sĂ©curitaire dans la bande de Gaza est trĂšs dĂ©gradĂ©e, [...] il n’en est pas de mĂȘme en Cisjordanie, oĂč, si des heurts Ă©pars sont constatĂ©s, la situation est globalement stable, et qu’il paraĂźt concevable que les intĂ©ressĂ©s puissent s’y installer. De mĂȘme, leurs enfants en sont encore aux premiers apprentissages scolaires, si bien qu’il n’est pas dĂ©montrĂ© qu’ils ne pourraient pas poursuivre cette scolarisation en Cisjordanie. » > > ##Leur demande d’asile rejetĂ©e en 2018 > > L’avocate du couple, Me Le Verger, dit avoir Ă©tĂ© abasourdie en dĂ©couvrant le contenu de ce mĂ©moire, adressĂ© aprĂšs la clĂŽture de l’instruction. « De maniĂšre gĂ©nĂ©rale, on Ă©tait plutĂŽt confiants sur leur demande d’admission exceptionnelle au sĂ©jour. C’est un couple amoureux de la France, lui est professeur de français, bĂ©nĂ©ficiant d’une promesse d’embauche et trĂšs actif dans la vie de leur commune. » > > L’avocate estime qu’il s’agit lĂ  d’un cas symptomatique de la politique du chiffre menĂ©e par le ministĂšre de l’intĂ©rieur, qui s’entĂȘte Ă  dĂ©livrer des OQTF Ă  des ressortissant·es de pays en guerre. « Il y a une volontĂ© d’expĂ©dier les dossiers, quitte Ă  crĂ©er de la prĂ©caritĂ© et de la souffrance. Les deux plus jeunes sont nĂ©s en France, et ne parlent que français. « Il n’y a que l’aĂźnĂ©e qui est nĂ©e Ă  Gaza », explique Shaden, qui s’étonne des arguments avancĂ©s par la prĂ©fecture. « Et puis, ils ne savent pas que les Gazaouis ont l’interdiction de se rendre en Cisjordanie ? » > > Pour le couple, ces passages ont eu l’effet d’une dĂ©flagration. « C’est choquant. On vit en France depuis six et huit ans. On parle français, on se sent français, on rĂȘve en français. On s’assume totalement depuis des annĂ©es et ils refusent de nous donner les papiers. » > > Professeur de français, Ibrahim a rejoint la France en 2016 avec un visa Ă©tudiant, aprĂšs un premier sĂ©jour Ă  Vichy en 2012 Ă  l’occasion d’une formation financĂ©e par une bourse. Shaden le rejoint deux ans plus tard, avec un visa Ă©quivalent, et poursuit ses Ă©tudes de langues pour se spĂ©cialiser en anglais. > > Lorsqu’ils dĂ©cident de demander l’asile, en juillet 2018, c’est la douche froide. L’Office français de protection des rĂ©fugiĂ©s et apatrides (Ofpra) rejette leur demande, la Cour nationale du droit d’asile (CNDA) vient confirmer cette dĂ©cision. Au bout de deux ans de procĂ©dure, ils tombent dans l’irrĂ©gularitĂ© mais se battent malgrĂ© tout pour rester. > > S’éloigner de la famille a sans doute Ă©tĂ© le choix le plus difficile de leur vie. « On avait notre vie lĂ -bas, notre logement, notre mĂ©tier de professeur. On est venus avec notre argent et on a assumĂ© tous les frais jusqu’à ce jour, sans aucune aide. » > > Mais ce qui les a poussĂ©s Ă  vouloir rester en France, prĂ©cisent-ils, « ce sont [leurs] enfants ». « C’est ce qu’on a de plus prĂ©cieux. Quand on a vu l’état psychologique de notre fille, ça nous a dĂ©cidĂ©s. On veut qu’ils vivent en paix. » C’est au vu du contexte que le couple a demandĂ© un rĂ©examen de sa demande d’asile auprĂšs de l’Ofpra le 21 janvier. > > ##Une vie suspendue > > L’audience au tribunal administratif, prĂ©vue le 24 janvier, a Ă©tĂ© reportĂ©e, sans date fixĂ©e encore Ă  ce jour, car la prĂ©fecture a rĂ©pliquĂ© avec son mĂ©moire en dĂ©fense la veille. En attendant de savoir s’ils obtiendront l’asile ou si l’OQTF sera annulĂ©e par la justice, Shaden ne vit qu’à travers les Ă©crans. « Ma vie s’est arrĂȘtĂ©e depuis que la guerre a repris. » La trentenaire a dĂ» mettre ses Ă©tudes en suspens, et surveille les chaĂźnes Telegram jour et nuit, Ă  la recherche de noms de proches dĂ©cĂ©dĂ©s. « Il y a tellement de morts qu’on tente de filtrer par rĂ©gion. » > > Le couple « angoisse tout le temps » pour ses proches, et reste sans nouvelles durant des semaines parce que ces derniers n’ont pas de connexion ou d’électricitĂ© pour charger leurs tĂ©lĂ©phones. Jusqu’au message dans lequel ils indiquent simplement ĂȘtre « vivants ». L’autre jour, son aĂźnĂ©e a compris que les cadeaux qu’elle avait fait parvenir Ă  sa cousine prĂ©fĂ©rĂ©e avaient Ă©tĂ© dĂ©truits dans les bombardements. « Ça lui a fait mal parce que ça lui tenait Ă  cƓur, c’étaient des choses qu’elle avait choisies elle-mĂȘme. » > > Dans l’entrĂ©e, un collier au pendentif incrustĂ© d’une photo de son frĂšre lui rappelle la douleur de n’avoir pas revu Majd avant qu’il ne disparaisse. Elle aurait pu voyager, avant que cette nouvelle Ă©tape de la guerre ne dĂ©marre, si elle avait eu « des papiers ». > > Elle dit n’avoir jamais obtenu de rĂ©ponse de la prĂ©fecture lors de sa premiĂšre demande de rĂ©gularisation, une fois son titre Ă©tudiant expirĂ©. Heureusement, note-t-elle, un rĂ©seau de solidaritĂ© local se mobilise pour leur venir en aide. Le tĂ©lĂ©phone ne cesse de sonner le jour oĂč nous les rencontrons. « Tu sais que le monsieur du bar PMU a reconnu ma tĂȘte dans le journal ?, lance Ibrahim Ă  son Ă©pouse. Il Ă©tait rĂ©voltĂ© de ce qui nous arrive. »
